1. Arbitration Notice

Except for certain disputes described in Section 19, you agree that disputes arising under the Terms will be resolved through binding, individual arbitration. BY ACCEPTING THE TERMS, YOU AND HELPFULPETS.COM, LLC WAIVE THE RIGHT TO A TRIAL BY JURY OR PARTICIPATION IN ANY CLASS ACTION. Disputes will be resolved by a neutral arbitrator rather than a judge or jury. See Section 19 for details.

2. Use of the Site

HelpfulPets.com, LLC operates the website located at www.helpfulpets.com (the “Site”). This platform assists users (“Users”) in obtaining an Emotional Support Animal (“ESA”) letter by connecting them with licensed mental health professionals (“Providers”). By accessing and using the Site, you agree to abide by these Terms and all associated policies.

YOU MAY NOT ACCESS OR USE THE SITE IF YOU ARE UNDER 18 YEARS OLD. IF YOU DO NOT AGREE WITH THESE TERMS, DO NOT USE THE SITE.

3. Mobile Message Service

HelpfulPets.com, LLC uses a mobile message service operated by a third-party provider. By using this service, you agree to:

• Receive automated text messages about updates, promotions, and account information.
• Understand that message and data rates may apply.
• Opt out anytime by texting STOP to +1 (844) 793-PETS (7387).
• Maintain an accurate, up-to-date mobile number.

4. Limited Scope of Services; No Doctor-Patient Relationship

HelpfulPets.com, LLC provides informational content only. The Site does not create a professional relationship between users and mental health professionals. Providers using the Site operate independently and are solely responsible for their services.

The Site does not offer medical or psychological advice. Always consult a licensed professional for diagnosis and treatment.

5. Refund and Cancellation Policy

Refunds and cancellations are subject to the following conditions:

1. ESA Letter Fee
   • The ESA Letter Fee is the amount charged for the ESA letter.
   • The first pet is included. Each additional pet is $5, charged at checkout, up to three pets total.
   • Additional-pet fees are part of the ESA Letter Fee and follow the refund rules for that fee.
2. Administrative Fees

   The following Administrative Fees apply as indicated or selected at checkout:

   • Therapist evaluation: $39.98 (charged on every order).
   • Mailed hard copy: $14.99, if selected at checkout.
   • Priority processing: $9.99, if selected at checkout.

   Administrative Fees are separate from the ESA Letter Fee.

3. Refund if Not Eligible

   If, after consultation, the Licensed Healthcare Professional (LHCP) determines that the user is not eligible for an ESA letter, HelpfulPets.com, LLC will refund all amounts paid for the ESA Letter Fee and all Administrative Fees charged on that order.

4. Refund after Landlord Rejection

   If an ESA letter is issued and a landlord rejects it, the ESA Letter Fee (including any additional-pet fees) is refundable only if both of the following occur:

   • the user submits written proof of the rejection (for example, the landlord's letter or email); and
   • the LHCP has completed the verification process applicable to that rejection and confirmed it.

   Administrative Fees are not refundable under this subsection.

5. Landlord- and School-Required Paperwork
   • Landlord- and school-required paperwork: $30 per request. This covers completing a third party's form, revising your letter to a third party's requirements, and denial-resolution support. The fee covers completed clinician work and is non-refundable. Requesting or declining this service does not affect your ESA letter or your eligibility for a refund under this section.

For California residents, ESA letters require a 30-day client-provider relationship before issuance per AB 468.

6. User Accounts

When registering on the Site, you must:

• Provide accurate account details.
• Be at least 18 years old.
• Maintain confidentiality of your credentials.
• Notify HelpfulPets.com, LLC immediately of unauthorized account access.

Failure to comply may result in account termination.

7. Intellectual Property and Licenses

All content on the Site, including text, images, and software, is owned by HelpfulPets.com, LLC and protected under U.S. and international copyright laws.

You are granted a limited, non-exclusive, and non-transferable right to use the Site for personal, non-commercial purposes only. You may not modify, distribute, or reproduce Site content without permission.

8. Disclaimer of Warranties

THE SITE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. HELPFULPETS.COM, LLC DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. USERS ASSUME ALL RISKS ASSOCIATED WITH SITE USAGE.

9. Limitation of Liability

HELPFULPETS.COM, LLC IS NOT LIABLE FOR:

• Direct or indirect damages resulting from Site use.
• Errors or omissions in Site content.
• User reliance on information provided through the Site.

Total liability is limited to the amount paid for services.

10. Dispute Resolution and Arbitration

All disputes between users and HelpfulPets.com, LLC must be resolved via binding arbitration. Users waive the right to participate in class-action lawsuits. Arbitration proceedings will be held in Los Angeles, California, unless otherwise agreed.

Users may opt out of arbitration within 30 days of accepting these Terms by submitting a written request.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
